  • Title Deed – Ensure the seller has a clear and marketable title in their name.

Encumbrance Certificate (EC)

  • Get the EC from the Sub-Registrar Office for the last 13–30 years.
    • Confirms the property is free from loans, mortgages, or legal liabilities.

Approved Layout s Building Plans

  • For plots: Verify BDA, BBMP, BMRDA, or CUDA approvals.
    • For apartments/villas: Ensure BBMP/BDA approved building plans.
    • Check DC Conversion Order if it was converted from agricultural to residential use.

Khata s Tax Records

  • For BBMP areas, ensure it is A-Khata (not B-Khata).
    • Verify property tax receipts are up-to-date with no arrears.

RERA Registration

  • For under-construction projects, confirm RERA registration.
    • Cross-check project details on the Karnataka RERA portal.

Sale Agreement s Sale Deed

  • Include payment terms, possession date, penalties for delay, and all inclusions/exclusions.
    • The Sale Deed must be registered at the Sub-Registrar Office within 4 months of execution.

Power of Attorney (POA)

  • If the seller is abroad or unavailable, ensure POA is properly executed and notarized.
    • POA must be registered in India to be valid for sale.

Loan Clearance

  • For resale properties with an active home loan, ensure loan closure and get a No Objection Certificate (NOC) from the bank before registration.
